TERMS & CONDITIONS OF SALE

These Terms and Conditions of Sale (“Terms”) govern the placing of orders ("Order") with PLUGZIT GmbH (PLUGZIT, the “Company”, “we”, or “ us”) for our Products (the "Product"). Please read these Terms carefully before submitting your Order of any number of PLUGZIT’s. By submitting your Order, you agree to be legally bound by these terms.

1. YOUR ORDER

When placing an Order for any number of PLUGZIT’s, you will be required to provide certain information, such as your address and billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. PLUGZIT shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact or shipping information. You can update your information at any time prior to your Order being shipped by sending an e-mail to hello@plugzit.com or changing any details directly on your customer account.

You acknowledge and agree that PLUGZIT may decline or delay your Order as it deems appropriate, provided that we inform you within three (3) days of receipt of your Order, and that you will be entitled to a full refund of the Purchase Price, including shiiping.

2. PAYMENT

You will be charged the full price of the product, including your local VAT & shipping fee at the time of placing the Order.

3. PRIORITY

The Company will deliver the Product according to the Order in which the Order is received.

4. DELIVERY SCHEDULE

We make efforts to despatch your Order within forty-eight (48) hours of you placing your order. If you place your Order on the weekend, your Order will processed on the next working day in order of Priority, See Section 3.and as soon as reasonably practicable. You understand and agree that there may be delays. An estimated time of delivery (ETD) is only an estimate, is subject to change, and PLUGZIT does not represent or warrant that it will be able to ship the Product by the estimated date. As a result, if a delay arises and the estimated shipment and/or release of the product is not met, the Company is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these Terms, to provide any discounts, refunds or credits due to any such delays. We will provide you periodical updates with respect to such delivery schedule in the case of any unforeseen delays. You may cancel your Order as provided for in Section 6 below.

5. PRICE

The purchase price ("Price") includes Swiss VAT (7.7%). In the case of international orders your price is automatically adjusted, and you or Us will be responsible for paying your local government charges, in compliance with local tax rules.

6. CANCELLATION & RETURNS

You or PLUGZIT may cancel your Order at any time prior to despatch. If you do so prior to despatch, you will obtain a full refund of the purchase Price including shipping costs, less bank processing charges. (sorry nothing we can do about this). If you decide to return your PLUGZIT for any reason whatsoever, you will receive a full refund of the purchase Price, less shipping and banking fees). Please see Our 100% Satisfaction Guarantee

7. LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES WILL THE COMPANY BE HELD LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OR RELATED TO THIS AGREEMENT OR YOUR PURCHASE. IN THE EVENT THE COMPANY IS HELD LIABLE FOR ANY DAMAGES ARISING OUT OR RELATED TO THIS AGREEMENT, YOUR SOLE AND EXCLUSIVE REMEDY WILL BE THE FULL REFUND OF YOUR PURCHASE PRICE AS DETAILED IN SECTION 6 ABOVE.

8. CUSTOMER INFORMATION

We will use any information that we may collect about you only in accordance with our privacy policy.

9. CHANGES TO THE TERMS

PLUGZIT GMBH reserves the right to change any of the terms for any or no reason. We will provide notice of any material changes and, if you are unhappy with such changes, your sole and exclusive remedy will be to cancel your Order as described in Section 6 above.

10. GOVERNING LAW & JURISTICTION

This Agreement shall be governed by and construed in accordance with the substantive laws of Switzerland. The Parties hereby consent to submit to the exclusive jurisdiction of Zürich courts in respect hereof.
